Terms of Service

These Terms of Service (“Terms”) govern your use of pictage (the “Service”), operated by Apache-3 Inc. (“we”, “us”, or “our”) and accessible at https://pictage.com.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service, or the age of majority in your jurisdiction, whichever is greater. By using the Service you represent that you meet this requirement.

2. Account registration

To access certain features you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your authentication credentials secure
  • Be responsible for all activity that occurs under your account
  • Notify us immediately at apache3corp@gmail.com of any unauthorized access

3. Acceptable use

You agree NOT to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to access, probe, or scan any system or network we operate
  • Reverse-engineer, decompile, or attempt to extract the source of the Service
  • Send spam, malware, or other harmful content through the Service
  • Impersonate any person or misrepresent your affiliation with any entity
  • Interfere with or disrupt the Service, servers, or networks

4. Subscriptions and payment

Some features of the Service require a paid subscription. Pricing, billing cycles, and refund policies are disclosed at the time of purchase. By subscribing you authorize us (and our payment processor, Stripe) to charge the payment method you provide on a recurring basis until you cancel.

You may cancel your subscription at any time via your account settings. Cancellations take effect at the end of the current billing period; we do not pro-rate partial periods.

5. Content ownership and license

You retain all rights to the content you submit to the Service (“Your Content”). By submitting Your Content you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely as required to provide the Service to you.

The Service itself, including all software, designs, text, graphics, and other content NOT submitted by you, is owned by Apache-3 Inc. or its licensors and is protected by copyright, trademark, and other laws.

6. AI-generated outputs

The Service may use third-party AI providers (such as Anthropic, OpenAI) to generate outputs based on your inputs. You acknowledge:

  • AI-generated outputs may be inaccurate, incomplete, or unsuitable for your specific use case
  • We do not guarantee the accuracy, completeness, or fitness for any particular purpose of AI outputs
  • You are solely responsible for reviewing AI outputs before relying on them
  • AI outputs are provided “as is” without warranty of any kind

7. Privacy

Your use of the Service is also governed by our Privacy Policy at https://pictage.com/privacy, which describes what personal data we collect and how we use it.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination your right to use the Service ceases immediately. Sections 5, 9, 10, 11, 12 survive termination.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Apache-3 Inc. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

11. Indemnification

You agree to indemnify and hold harmless Apache-3 Inc. from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing law and disputes

These Terms are governed by the laws of Pennsylvania, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Pennsylvania, United States, and you consent to personal jurisdiction there.

13. Changes to these Terms

We may modify these Terms at any time. Material changes will be communicated via the Service or via email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
